Acceptance of Terms

Welcome to TailyTales. By downloading, installing, accessing, or using our mobile application and related services, you agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and TailyTales.

Service Description

TailyTales is a pet care and memory-keeping mobile application that helps users:

• Create and manage pet profiles and health records
• Track veterinary visits, medications, and vaccinations
• Capture and organize pet photos and moments
• Set and receive care reminders and notifications
• Sync reminders with Google Calendar (optional)
• Access premium features through subscription plans (when available)

Current Service Status

TailyTales is currently available as a free application with all core features included. Premium subscription plans may be introduced in the future to provide additional features and enhanced functionality.

User Accounts

Account Creation

• You may use TailyTales without creating an account for basic functionality
• Google Calendar integration requires Google account authentication
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use our services

Account Responsibilities

• Provide accurate and complete information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access
• You are responsible for all activities that occur under your account

Subscriptions & Billing

Subscription Plans

When available, TailyTales may offer subscription plans that provide:

• Enhanced pet health tracking and analytics
• Advanced reminder and notification features
• Cloud backup and synchronization
• Priority customer support
• Early access to new features

Billing Terms

• Subscriptions will be billed through your Apple App Store or Google Play account
• Payment will be charged to your account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's account settings
• No refunds for the current active subscription period

Free Trial

When offered, free trials allow you to experience premium features before committing to a subscription. Trials will automatically convert to paid subscriptions unless cancelled during the trial period.

User Responsibilities

Appropriate Use

• Use TailyTales only for its intended purpose of pet care management
• Provide accurate information about your pets' health and care
• Respect the privacy and rights of others
• Comply with all applicable laws and regulations

Content Guidelines

• You are responsible for all content you create, upload, or share
• Do not upload content that is illegal, harmful, or inappropriate
• Respect copyright and intellectual property rights
• Content should be related to pet care and appropriate for all users

Device and Data

• Maintain your device's security with up-to-date software
• Backup your important data regularly
• Be aware that uninstalling the app may result in data loss

Content & Intellectual Property

Your Content

• You retain full ownership of all photos, text, and data you input into TailyTales
• You grant us a limited license to process and display your content within the app
• We do not claim ownership of your pet photos, health records, or personal information
• You can delete your content at any time through the app

Our Intellectual Property

• TailyTales app, design, features, and branding are our intellectual property
• You may not copy, modify, or distribute our app or its components
• All trademarks, logos, and service marks are our property

Prohibited Use

You agree not to:

• Use the service for any illegal or unauthorized purposes
• Attempt to reverse engineer, hack, or compromise the app's security
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users or animals
• Violate any laws or regulations in your jurisdiction
• Use the app for commercial purposes without our written consent
• Create fake accounts or impersonate others
• Interfere with the proper functioning of the service

Service Availability

Service Provision

We strive to provide reliable and consistent service, but we cannot guarantee:

• 100% uptime or availability
• Compatibility with all devices or operating system versions
• Uninterrupted access to third-party integrations (like Google Calendar)
• Error-free operation

Maintenance and Updates

• We may perform scheduled maintenance that temporarily affects service availability
• App updates may be required for continued functionality
• Features may be modified, enhanced, or discontinued with notice

Limitation of Liability

Service Limitations

TailyTales is provided "as is" without warranties of any kind. We are not liable for:

• Data loss due to device failure, app uninstallation, or technical issues
• Decisions made based on information stored or displayed in the app
• Third-party service interruptions or integration failures
• Indirect, incidental, or consequential damages

Maximum Liability

Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

Consumer Rights

Statutory Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable law. In jurisdictions where limitations of liability are not permitted, the limitations above may not apply to you.

Regional Consumer Protections

• European Union: You have rights under EU consumer protection laws that cannot be waived by these Terms
• Australia: Our services come with guarantees under the Australian Consumer Law that cannot be excluded
• United States: Some states do not allow limitations on implied warranties or liability exclusions
• Other Jurisdictions: Local consumer protection laws may provide additional rights

Termination

Termination by You

• You may stop using TailyTales at any time
• Delete the app from your device to terminate your use
• Cancel any active subscriptions through your device's account settings
• Revoke Google account access if you enabled calendar integration

Termination by Us

We may terminate or suspend your access if you:

• Violate these Terms of Use
• Engage in prohibited activities
• Pose a security risk to our service or other users

Effect of Termination

• Your right to use the service ends immediately
• Local data on your device may be retained until you delete the app
• Active subscriptions continue until their expiration date
• These Terms survive termination for applicable provisions

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where TailyTales operates, without regard to conflict of law principles.

Dispute Resolution

• We encourage users to contact us first to resolve any disputes informally
• Most issues can be resolved through direct communication
• Legal disputes shall be subject to the jurisdiction of competent courts
• Where applicable, consumers may access alternative dispute resolution mechanisms

Changes to Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. When we make significant changes:

• We will notify you through the app with a prominent notice
• Updated Terms will be posted at tailytales.app/terms
• We will update the "Last Updated" date at the top of these Terms

We review these Terms at least annually. For material changes, we will notify you in-app and update the Effective Date at least 14 days in advance.

Your continued use of TailyTales after changes indicates your acceptance of the updated Terms.
